Legal Comment
How could a court decide to imprison 1,378 citizens for 45 days pending investigations in just two days (June 4, 5)?
How could it do that collectively and without regard to their detention renewal session, because they exceeded the maximum limit of pretrial detention in the Code of Criminal Procedure, which is set at 24 months?
Such as the case of photojournalist Hamdi Al-Zaeem, who has completed his third year of pretrial detention since his arrest from his home in January 2021?
As well as activist Nermeen Hussein, who is completing her third year in pretrial detention after rotation in January 2021?
Terrorism Chambers confirm there is no room for the provisions of the law in a country that has transformed pretrial detention from a precautionary measure to a means of torture and revenge against opponents of the current regime.
In a trial, that has lacked all guarantees and standards of a fair and just trial, as well as the rights of the defense and the accused, Mataria Misdemeanor Court of Appeal ruled to accept the appeal opposition by lawyer Muhammad Abu Al-Diyar. The ruling to accept was in form and substance, by rejecting it and upholding the 1-year Imprisonment ruling in the case known in the media as the case of the power of attorney documents. Al-Diyar is the manager of the presidential campaign of former parliamentarian Ahmed Tantawi.
The ruling came after the court ignored the defense requests to summon the officer conducting the National Security Sector investigations. The court also refused to hear the defendant’s statements, which the court ignored.
With the defense adhering to its requests, the court issued its ruling without hearing the defense or investigating the requests, in violation of the provisions of the Constitution, the Criminal Procedure Code, and the Law on the Legal Profession, which all confirm the trial procedures are merely a formality.
