Legal Comment
Cairo Criminal Court
Supreme State Security Prosecution
The Supreme State Security Prosecution has decided to renew the detention of Engineer Yahya Hussein Abdel Hadi despite informing his lawyer that he had suffered a heart attack inside his cell and his detention in the intensive care unit of the prison hospital for 4 days. That came to highlight one of the problems of pretrial detention, and its excessive use, which contradicts the presumption of innocence that every accused must enjoy until proven guilty in a fair trial.
The failure to take into account the health conditions of Engineer Yahya and ignoring the seriousness of his health condition reflects the abuse of the power of pretrial detention and the absence of the requirements of justice and the rights of individuals.
The phenomenon of “rotation” in the Sharqia seems like an endless loop, striking the idea of justice with a fatal blow. The continuation of this phenomenon requires a real stance, emphasizing that the justice apparatus is in the service of the law, not the authorities.
