Legal Comment

Enforced disappearance is a hateful and widespread phenomenon, despite the continuous denial by Ministry of Interior of its practice. An example is the case of citizen Mosaab Saber, who appeared after four years of disappearance, to face a decision of pretrial detention in case No. 6026 of 2024 Supreme State Security, without investigating his detention inside a security headquarters since his arrest on 30 June 2020 from in front of a mosque in Kafr Al-Azzazi, Abu Hammad Center in Sharqia.

This approach perpetuates impunity, emptying constitutional texts and international agreements to which the state is committed of their content. It also confirms the urgent need for fundamental reforms to guarantee the right of the accused to a fair trial, and to put an end to the exploitation of exceptional measures to undermine justice.
