Legal Comment
Burg Al Arab prison administration denies the presence of labour leader Shadi Mohamed, who is in pretrial detention pending case No. 1644 of 2024 State Security, known in the media as the “Support Palestine Banner” case, during the session to consider renewing his detention. This raised increasing concerns and fears about his fate and health condition, especially after his wife confirming that he had been on a hunger strike since 29 January, in protest against his transfer from 10th of Ramadan prison to Burg Al Arab, and the confiscation of his personal belongings.
This denial came a few days after his wife filed a report to the Public Prosecutor regarding the strike, while officials at 10th of Ramadan prison-VI confirmed to the head of the court that he had indeed been transferred to Burg Al Arab, raising questions about his true fate and actual place of detention.
Despite the seriousness of these circumstances and the clear violation of the rights of detainees, the court ignored these developments and did not take any action to verify his place of detention or check on his health condition, which raises concerns about his fate in the absence of any accountability.
The continued investigation by State Security Prosecution of citizens over calls for demonstrations that did not take place on 25 January raises special legal problems, in light of the absence of any actual gatherings or actions related to demonstrations or protests, clarifying the punishment for mere calls that were not translated into action, and creates a climate of intimidation and punishment for mere intentions or opinions.
