Legal Comment
Ahmed Abdel Moneim Aboul Fotouh was arrested because he had been convicted in absentia in the same case as his father, former presidential candidate Abdel Moneim Aboul Fotouh, which is shocking.
Neither Ahmed, his lawyers, nor his family knew he was even a defendant in the case. He had been living a normal life for years, until he went to renew his driver’s license, when he was arrested and taken to the 10th of Ramadan Prison, pending a retrial for the 10-year sentence imposed on him!
How and why was he not notified from the beginning to defend himself?
These questions once again confirm the absence of the rule of law and the values of a fair trial.
The Terrorism Chamber of the Cairo Criminal Court, during the pretrial detention renewal hearings in State Security cases, on 15 April, terminated contact with the 10th of Ramadan Prison-VI and renewed the detention of all defendants without their presence or hearing.
This constitutes a clear violation of Article 54 of the Egyptian Constitution, which guarantees every detainee the right to contact their lawyer, as well as Article 143 of the Criminal Procedure Code, which requires the court to present the defendant to the hearing when considering a detention renewal, stripping the court of its inherent status.
