The other memorandum was to the Appeals Prosecution Office to determine a chamber to consider the dispute over the implementation of the sentence in Case No. 1228 of 2021, State Security Misdemeanor, 5th Settlement Emergency, copied from Case No. 1356 of 2019, Supreme State Security.
Legal Comment
Cairo Criminal Court, Terrorism Chamber-II, held in Badr Prison decided to refuse to release human rights lawyer Hoda Abdel Moneim during the first session of her trial in State Security Case No. 730 of 2020.
This raises critical legal and human rights questions, especially since this referral came after the completion of her sentence, which she had served to a ruling by the same court in the case known in the media as the “Egyptian Coordination for Rights and Freedoms” case. The case had the same charges of joining a terrorist group and committing a crime of financing terrorism.
This raises suspicions of the “rotation” for the purpose of continuing her detention. The seriousness of the decision is in light of the evidence of her deteriorating health, as she attended the trial in an ambulance. She suffers from serious health problems, including: chronic deep vein thrombosis, pulmonary embolism, high blood pressure, and severe joint inflammation. She also has a history of heart problems. During her detention, she suffered from a heart attack, complete kidney failure in left kidney, and regurgitation in the right kidney.
Despite this critical health condition, the court did not take into account Article 486 of the Code of Criminal Procedure, which allows for the postponement of custodial sentences for health reasons. This constitutes a clear violation of constitutional guarantees, guaranteeing the right to life and the right to adequate healthcare. It also raises doubts about the adherence to considerations of justice and humanity in such legal and human rights cases.
