Legal Comment

Cairo Criminal Court, Terrorism Chamber-II, held in Badr Prison issued a 10-year prison sentence against former student leader Moaz al-Sharqawi, in a case he was suddenly referred to last May, without any investigation.

The State Security Prosecution considered him a “fugitive,” despite being in pretrial detention at the time in Case No. 540 of 2023 Supreme State Security, where he was arrested at his home in Mokattam on 11May, 2023, and forcibly detained for 22 days before appearing before the prosecution on 3 June.

This sentence marks Moaz’s second conviction, following another 10-year prison sentence in the case known in the media as the “Abdel Moneim Aboul Fotouh case.” He faces 20 years of harsh sentences in cases with a predominantly political nature. The repeated issuance of harsh sentences in flawed legal contexts, and without genuine guarantees of a fair trial, reveals a pattern of systematic harassment of young and independent voices, and stresses that what Moaz Al-Sharqawi is being subjected to is not merely an individual injustice, but rather part of a broader policy that narrows the public sphere and uses the judiciary as a tool for political intimidation.

Less than a week after economist Abdel Khaleq Farouk had appeared before the State Security Prosecution, they investigated Eng. Yahya Hussein Abdel Hadi from his prison cell in Case No. 3916 of 2024 State Security, without issuing a release order, despite the availability of justifications for release stipulated in the Criminal Procedure Code, confirming a systematic approach by the State Security Prosecution to summon and continue to detain public figures and peaceful opposition figures, without any real justification or transparent procedures.
