The defense team for activist Mohamed Adel filed a report against Gamasa 2 Prison (Shady Mohamed Hassan) accusing him of obstructing and not implementing judicial orders issued by the Public Prosecution (Belqas Prosecution and North Mansoura General Prosecution) to obtain <\/span>a personal ID card and a criminal record for Mohamed Adel while he was in prison.<\/span><\/p>\n

Legal Comment<\/span><\/strong><\/p>\n

After eight days of violating the Criminal Procedure Law, where a session was held to renew the detention of citizen\/ Ihab Masoud <\/span>Go<\/span>ha, who has been in pretrial detention for more than five years pending case No. 1358 of 2019<\/span><\/p>\n

Supreme State Security, known in the media as the “Independence Party” case, and his failure to attend and appear before the court as he was on a ventilator at the Amiri Hospital in Alexandria<\/span>. <\/span>And a decision was issued to continue his pretrial detention for 45 days by Counselor\/ Wagdy Abdel Moneim, Head of the at the Cairo Criminal Court<\/span>, Terrorism Chamber-III. <\/span>He died inside his detention center in intensive care after his health condition deteriorated. During the five years, Juha’s health deteriorated during his illegal detention<\/span>. <\/span>In addition to suffering from diabetes, the complications of which appeared during his detention<\/span>, h<\/span>e was infected with water on his lungs in Badr 1 Prison<\/span>. <\/span>During his third year of illegal pretrial detention, and with the deterioration of his health condition, he became a wheelchair-bound person unable to move independently,<\/span> h<\/span>is health condition required repeated water extractions on his lungs<\/span>. <\/span>However, the prisons only performed the operation twice<\/span>. <\/span>With the sufficiency of giving him antibiotics, which affected his general health, so <\/span>Goha<\/span> passed away after suffering that could have been avoided by applying the texts of the law and not the spirit of the law<\/span>. <\/span><\/p>\n

The campaigns of arresting citizens in Sharqia and referring them to the prosecution on charges of joining groups without providing clear evidence,<\/span> raise serious questions about the commitment to the legal and human rights framework that must be followed to ensure the achievement of justice and the protection of the basic rights of individuals<\/span>. <\/span>From a legal standpoint, Egyptian law requires that any accusations against individuals be based on conclusive evidence and indications, which was not available in most of these cases.<\/span><\/p>\n

The refusal of the warden of Gamasa 2 Prison to implement the decisions of the Belqas and North Mansoura General Prosecutions to issue a personal ID card and a criminal record for activist Mohamed Adel in his prison represents a violation of the authority of the Public Prosecution,<\/span> and reflects a state of rebellion against the decisions of the judiciary, and this refusal is also a violation of the rights of detainees to obtain official documents that guarantee their right to defend themselves or exercise their legal rights.<\/span><\/p>\n<\/article>\n<\/section>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"
