                The official spokesman of the armed forces published on the official page on the social networking site Facebook that one of the security personnel in charge of securing the international border line was chasing drug smuggling elements.. During the pursuit, the security personnel breached the insurance barrier and exchanged fire, which led to the death of (3) members of the Israeli armed forces personnel and the wounding of (2) others, in addition to the death of the Egyptian security personnel during the exchange of fire.<\/span><\/span><\/p>\n

                Monday, June 5, 2023<\/span><\/span><\/p>\n

                1. The Public Prosecution Office published a statement on its official page on the social networking site Facebook, stating that the case of the accused \/ Heba Sayed, owner of the \u201cUmm Ziyad Wahba\u201d channel on social media, and her son and husband, has been transferred to the Criminal Court, with an order to arrest and bring the latter and imprison him – like the other two defendants – to punish them for what was assigned to them for committing the first crime of human trafficking by dealing with natural persons, who are her children, with the aim of increasing viewership and achieving financial profit.<\/span><\/span><\/p>\n

                2. The official spokesperson for the Presidency of the Republic published on the official page on the social networking site Facebook that the President of the Republic, Mr. Abdel Fattah El-Sisi, received a phone call from Israeli Prime Minister Benjamin Netanyahu, during which they discussed the shooting incident that took place at the Egyptian border with the Israeli occupation state on Saturday, June 3, 2023, which led to the deaths of border security personnel, and the two parties stressed the importance of full coordination to uncover all the circumstances of the incident, and their intention to continue work and coordination in the context of bilateral relations, and the pursuit of a just and comprehensive peace and maintaining stability in the region.<\/span><\/span><\/p>\n

                Legal Comment<\/u><\/span><\/span><\/p>\n

                – After 23 days of enforced disappearance – during which the former student leader and human rights defender Moaz Al-Sharqawi was subjected to wholesale violations that constitute criminal offenses, including crimes whose punishments do not fall under the statute of limitations – the Supreme State Security Prosecution interrogated him after he appeared before it, accusing him of joining a terrorist group and financing and supplying the group, in Case No. 540 of 2023, Supreme State Security, and his remand detention and placement in the \u201cnotorious\u201d Badr 3 Reform and Rehabilitation Center, so that the series of violations against \u201cAl-Sharqawi\u201d continues, which began with his arrest from his home on May 11, 2023 without informing him of the reasons for his arrest or enabling him to inform his lawyer or one of his relatives in accordance with the text of the Egyptian constitution in Article 54 of it, which the Public Prosecution violated despite the fact that the family of Moaz Al-Sharqawi and his lawyers submitted a number of communications to the Counselor and Public Prosecutor from the date of his arrest until a few hours before the date of his presentation to the State Security Prosecution to demand disclosure of his place of detention and the reasons for his arrest.<\/span><\/span><\/p>\n

                – The decision of the Supreme State Security Prosecution to hold remand detention sessions for remand detainees through the \u201cvideo conference\u201d technique came as a disappointment towards reforming the legal justice system in Egypt and towards the return of the normal course of trials and remand renewal sessions and the availability of fair and equitable trial standards, the most important of which is the appearance of the accused before the judge. This is the normal standard, which is negated with the holding of sessions through the \u201cvideo conference\u201d technology, during which the accused remains inside his prison cell and his contact with his natural judge is through a technique controlled by those responsible for the prison he is placed in and the judge present in the court, and they are the only ones who control when the accused is allowed to speak and when not he is allowed, in addition to the absence of another criterion of fair and equitable trial, which is the accused\u2019s contact with his lawyer, which was available for the accused to meet with the lawyer inside the prosecution\u2019s headquarters every 15 days before reaching the stage of detention renewal inside the counseling room, and the accused\u2019s contact with his lawyer was cut off.<\/span><\/span><\/p>\n

                – The First Chamber of Terrorism in the Cairo Criminal Court issued its verdict in the case known in the media as the Minya terrorist cell case, in which 10 defendants, including 6 women, are being tried. The verdicts closed on a trial that lasted for nearly 6 months, during which four sessions were held with harsh sentences between death penalty for 4 defendants and aggravated 15 years for 5 defendants, and imprisonment for 3 years for one defendant. It is noted from the number of trial sessions that it came quickly and lacks fairness against the defendants, so how can it be rational or logical that the court has concluded and formed its doctrine through only four sessions to issue harsh rulings such as those issued.<\/span><\/span><\/p>\n

                <\/a>– The decision of the First Chamber of Terrorism in the Cairo Criminal Court came to postpone the consideration of the order to extend the preventive detention issued against the poet Galal Al-Beheiri because he was unable to attend the session due to the deterioration of his health condition after he entered an open strike on food and drink and taking heart and depression medicines in protest of his continued pre-trial detention, which violates the law. Criminal procedures for exceeding the maximum limit stipulated under the last paragraph of Article 143 to bring to mind his friend, director Shadi Habash, whose pretrial detention exceeded the maximum limit and continued his imprisonment until he died inside his prison in Torah Investigation Prison and raises an important question when the courts and prosecutions implement the provisions of the law and are they waiting for more deaths inside headquarters of detention to activate the provisions of the law regarding pretrial detention.<\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"
