He was in pretrial detention pending case No. 1513 of 2022, Darb Negm.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>Saturday, 6 January<\/p>\n<ol>\n<li aria-level=\"1\">The death of lawyer Mohamed El-Sherbini Ali El-Said in his prison cell in Badr Prison, after his health condition deteriorated following multiple transfers from one prison to another and settling in Badr Prison to undergo PET scan for many diseases, including cancerous tumors..<\/li>\n<\/ol>\n<p>Legal Comment<\/p>\n<p>With the beginning of the New Year, Supreme State Security Prosecution continues investigating dozens.<\/p>\n<p>As Supreme State Security Prosecution investigated \u2013 during the newsletter&#8217;s coverage period \u2013 18 citizens, and put them in pretrial detention for joining a terrorist group and financing and supplying a terrorist group, based National Security reports. Those citizens include arrests and appearances from varying periods of disappearance.<\/p>\n<p>In investigating the citizens, the prosecution relied on the articles of the Anti-Terrorism Law No. 94 of 2015, amended by Law No. 15 of 2020, which carries suspicion of unconstitutionality, especially Article 40, which gives the right to the judicial police officer to detain citizens for 14 days before presenting them to the prosecution for investigation.<\/p>\n<p>&nbsp;<\/p>\n<p>The New Year is no different from the previous year with regard to the issue of pretrial detention, as Cairo Criminal Court, Terrorism Chambers, in Badr Prison, continued to renew the pretrial detention of dozens of citizens pending investigation by the Supreme State Security Prosecution, and on vague charges.<\/p>\n<p>Those charges have no single piece of evidence in the papers, except for the investigations of the National Security Sector, which sees all citizens as belonging to a terrorist group.<\/p>\n<p>In addition to those who exceeded the maximum limit of pretrial detention stipulated in the last paragraph of the text of Article 143 of the Code of Criminal Procedure. The text states that the violation is limited to a period of 6 months in misdemeanors, 18 months for felonies, and two years if the crime is punishable by death or life.<\/p>\n<p>Among the detainees is journalist Mustafa Al-Khateeb, who has entered his fifth year in pretrial detention in Case No. 488 of 2019 since his arrest in October 2019.<\/p>\n<p>&nbsp;<\/p>\n<p>The death of both Adel Radwan Othman and Muhammad El-Sherbini Ali.<\/p>\n<p>The latter suffered the deterioration of his health condition after his transfer from the 10th of Ramadan Prison to Badr Prison to undergo a PET scan for several cancerous tumors.<\/p>\n<p>This confirms that prolonged pretrial detention is the graveyard that the authorities use to get rid of citizens, and it has transformed from being a precautionary measure for the benefit of the investigation into a tool of revenge for the benefit of the authorities.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Summary: State Security investigations continue into 18 citizens on charges of terrorism and spreading false news.
