Legal Comment
In paragraph 1 of Article 143 of the Code of Criminal Procedure, the legislator required the competent judge to review extending pretrial detention before issuing his decision, as well as listen to the statements of the Public Prosecution and the accused. All the sessions in Cairo Criminal Court, Terrorism Chamber-III, in Badr Prison to renew the detention of citizens in cases investigated by the Supreme State Security Prosecution and lasting for 3 days missed the before mentioned procedure. Especially since the detention renewal hearings are electronic (video conference), with the accused inside his prison cell and presented to the court through a screen connected online, and in the presence of the security leaders responsible for the accused place of detention. This means that the court does not enable the accused to talk to it or hear his statements regarding what is attributed to him nor enables him to defend himself in violation of the text of the article.
The ruling on the opposition and former parliamentarian Ahmed Tantawi came from Mataria court last February against Tantawi, his election campaign manager Muhammad Abu Al-Diyar, and 20 of his supporters. This ruling came from the court to prove that there is no room or space for any attempt to move towards democracy.
