Legal Comment

Supreme State Security Prosecution continues to use the Anti-Terrorism Law to imprison citizens without evidence.

In this context, 42 citizens from different governorates appeared in the State office after arresting and charging them with the same aforementioned charges of “joining a banned group” and then imprisoning them for 15 days pending investigation.

Cairo Criminal Court, Terrorism Chambers, in Badr Prison, closed the curtain on the trial of activist Mahmoud Mohamed in the case known in the media as the “T-shirt Detainee” case, and issued a 3-year prison sentence with labor on the grounds of accusing him of joining an illegal group and participating in a demonstration. The security forces arrested the activist from inside the courtroom, to complete serving the sentence, as he had spent about two years and ten months in pretrial detention pending the case in 2016.

On June 29th, Counselor Wagdi Abdel Moneim, head of Cairo Criminal Court, Terrorism Chamber-III, held in Badr Prison, continued to trample the Code of Criminal Procedure while examining the detention renewal session of more than 1000 male of female citizens pending the cases of the Supreme State Security Prosecution. Almost half are citizens whose detention has exceeded the maximum limit specified for pretrial detention by law. The Counselor decided to ask the lawyers present in the deliberation room to consider the renewal without the presence of the defendants, justifying it by the large number of detainees. A request that found rejection from the defense team as well as the leave in protest of more than 70 lawyers stressing that the detention renewal session is the only means of direct communication between the accused and his defense. The result was renewing the detention for all without defense present.
