The terrorism chambers continue to issue decisions to renew pretrial detention without decisions to release for more than three years, with renewal decisions in some cases, without presenting the accused to the court. This actually happened with Engineer Yahya Hussein in the session on 10 February.
This manner reflects a dangerous pattern of using pretrial detention as an unannounced punishment, in violation of its origin as a temporary precautionary measure.
The failure to present the accused to the court during the session of the renewal of his detention is a clear violation of the guarantees of a fair trial, since his right to both defend himself and object to the continuation of his detention is denied, leading to the renewal decisions being just a formality without a real examination of their legitimacy.
The absence of any decisions of release for this long period also confirms that these chambers consider pretrial detention as an automatic procedure rather than as an exception with strict legal conditions.
These practices not only violate the rights of detainees, but undermine the justice system as well, which calls for a serious review to ensure that pretrial detention does not turn into an extended punishment without trial, and that the judicial authorities adhere to the constitutional and legal guarantees that protect the right to freedom and a fair trial.
