Legal Comment
Holding dozens of trials simultaneously inside Cairo Criminal Court, Terrorism Chamber-I, held in Badr Prison, and the presence of hundreds of defendants in the dock, raises serious questions about the commitment of the judicial authorities to fair trial standards and guarantees.
Numerous defendants have been observed suffering from collapse and severe fatigue due to the overcrowding inside the cage, without any significant attention to this by the court, ignoring the humanitarian and health conditions surrounding the sessions.
Furthermore, transforming prison halls into closed courts, where cases and defendants are crowded together in inhumane conditions, undermines the principle of public hearings as well as isolates defendants from their lawyers and families, not to mention that it creates an unfavorable environment in terms of achieving justice, and even perpetuates a pattern of “formal justice” that undermines the substance of trials.
