Legal Comment
Cairo Criminal Court, Terrorism Chamber-I, held in Badr Prison issued a ruling to remove the name of political activist and prisoner of conscience Alaa Abdel Fattah from the list of terrorist entities.
This represents an important step towards correcting the mistake or crime of persecuting opponents through the application of counterterrorism laws. Alaa’s inclusion on the terrorist list was not based on any crime in the legal or constitutional sense, but rather came in the context of the rejection of his views and peaceful activism.
This ruling also restores Alaa’s reputation, albeit partially, and confirms that the criteria for inclusion must be subject to strict review rather than being a tool for political punishment.
Inside Badr-III Prison, a number of detainees, most recently Dr. Mohamed El-Beltagi, have continued their hunger strike, which is a dangerous indicator reflecting the extent of the suffering and violations to which detainees in this prison are subjected, amidst denials from the Ministry of Interior.
A hunger strike is not a passing act, but rather, a final cry of protest by detainees when justice is absent and all avenues of grievance and redress are closed to them.
The successive hunger strikes, particularly in Badr-III Prison, confirm that the prison has become a battleground for violations, with detainees denied their most basic rights, such as exercise, visits, healthcare, and communication with the outside world. The silence from the Ministry of Interior reflects a lack of transparency and oversight, raising further questions about the absence of the Public Prosecution and its role.
