Legal Comment
Shorouk Misdemeanor Court sentenced economic expert Abdel Khaleq Farouk
on charges of “spreading false news” on social media, to 5-years imprisonment, based on his views and analyses regarding the economic situation of the country. This raises serious questions regarding the commitment of the court to fair trial guarantees, especially in relation to the failure to provide the defense team with a copy of the case documents, or full access to the evidence in question. This constitutes a violation of the right to defense, as stipulated in the law, the constitution, and the International Covenant on Civil and Political Rights.
In a move that once again highlights the reality of freedom of expression in Egypt, the Supreme State Security Prosecution investigated political activist Ahmed Douma for the second time in less than a month, in a new case, which is his sixth in a short period, based on his Facebook post addressing the allegations that former Minister of Supply Bassem Ouda had been assaulted inside Badr Prison, pointing out that the same officer had previously assaulted him personally during his detention in Tora Prison, and then acquitted him on an L.E. 50,000.
Imposing a high bail now has been a form of indirect pressure, transforming the exercise of the right to expression into an economic burden that limits participation in the public sphere.
