Legal Comment
In an expected move, the Supreme Administrative Court decided to exclude Engineer Haitham Al-Hariri from the list of candidates, based on his exemption from military service.
This decision, however, reinforces the political argument that political vengeance has overridden judicial decisions, and that the court intends to create a parliament without serious opposition.
The defense of economic expert Abdel Khaleq Farouk requested a response from the Shorouk Misdemeanor Appeals Court, following a series of practices that reflected the clear intransigence of the court in dealing with defense requests, most notably the refusal to allow the defense to obtain a copy of the case documents, which is a fundamental right.
This and then proceeding with the case despite the procedural imbalance, renders justice void of its substance and is legally justified, which raises serious questions about the extent to which some judicial circuits respect the principle of a fair trial and the right to defense as a fundamental pillar of the rule of law, especially in cases of a public or political nature.
The health of Dr. Mohamed Al-Beltagi, a leader of the Muslim Brotherhood, who is being held in Badr-III Prison, Sector-II, has deteriorated due to a mass strike by a number of inmates protesting ill-treatment and harsh conditions inside the prison.
Information indicates that Al-Beltagi, who suffers from kidney failure and hypertension, participated in the strike to protest the deprivation of the most basic rights of the prisoners, which has led to the deterioration of his health, rendering him dependent on a wheelchair.
This constitutes direct legal responsibility for the Ministry of Interior and the Prisons Authority, as well as the Public Prosecution that is not exempt from this deliberate negligence.
