Legal Comment
– In a clear violation of the provisions of the constitution, the law, and the provisions and principles of the Egyptian Court of Cassation, the security forces in the Suez governorate arrested the citizen / Ola Mustafa Afifi while exercising her constitutional right to peaceful expression of opinion, after she raised a banner in front of the Suez Governorate General Court criticizing the power outage crisis for many the governorates of the Arab Republic of Egypt, including the Suez governorate, and the decision to arrest the citizen and refer her to the Public Prosecution and accuse her of gathering and demonstrating without a permit from the competent authorities was in violation of the text of Article No. 65 of the Egyptian Constitution, which stipulates that “freedom of thought and opinion is guaranteed: Every person has the right to express his opinion verbally.” writing, photography, or other means of expression and publication.
The denial statement issued by the Egyptian Ministry of Interior on its official page on the social networking site Facebook about complaints issued by inmates of the Tenth of Ramadan Prison about the presence of surveillance cameras inside their cells was brief, contenting itself with attributing this news to pages and websites loyal to the Muslim Brotherhood, which is not evidence. Conclusively on the non-existence of these allegations, and the Ministry of Interior must allow an independent committee that includes a member of the National Council for Human Rights and the National Council for Women and representatives of the defense of inmates who are inside the Correction and Rehabilitation Center of the 10th of Ramadan City to move to the prison and enter their cells and inspect them on the ground.
In a clear violation of the personal freedom of citizens, which the constitution considered a basic right that should not be infringed upon, the National Security Forces continued to disappear the activist Ahmed Hamdi Al-Sayed, known as Ahmed Gika, for the 45th day without disclosing his place of detention, allowing him to speak to his lawyer or his family, or presenting him to any of the investigation bodies, after he was summoned to the agency’s headquarters on the thirteenth of June 2023 and detained upon his arrival.
