  1. The student Mahmoud Hussein, known in the media as “the T-shirt detainee,” appeared at the East Cairo Public Prosecution Office, after en forced disappearance for 5 days. During prosecution, Mahmoud signed a request to restart the procedures regarding the ruling in absentia issued on February 26 against him by the Emergency State Security Criminal Court to life imprisonment in Case No. 37883 of 2017, Al-Marg.

Legal Comment

Student Mahmoud Hussein (known to media as “the T-shirt detainee) appeared in East Cairo Total Public Prosecution Office following a 6 days enforced disappearance and illegal detention in one of the National Security offices to enable him to sign the report of the re-proceedings on the life sentence issued against him in absentia in Case No. 37883 of 2017 Al-Marg.

The student confirmed to his lawyer his stay for several days in one of the National Security offices since his arrest on August 30, 2023, before transferring him to Khanka prison, and that he remained blindfolded for the first three days of his detention. All this happened while the Public Prosecution did not investigate the legal violations against him, in terms of taking him to an unknown destination and his enforced disappearance, in violation of the provisions of the Egyptian Constitution and the Code of Criminal Procedure.

The severe expansion of the application of the provisions of the Terrorism Law, including its provisions that violate the Constitution, by the State Security Prosecution continues. Where 23 citizens were brought before the prosecution on terrorist charges under investigations by National Security officers and after investigation sessions that usually included only one question about the circumstances of the social and religious upbringing of those arrested, to always end with the issuance of a pretrial detention decision without any real investigations that included the elements of the accusations against them.

In serious violation of the law, the phenomenon of recycling arrested citizens continues where citizens from Sharqia either those who obtained acquittal rulings from the courts or who received release decisions from the Public Prosecution re-imprisoned them again under false records.

Cairo Criminal Court, Circuit-II Terrorism held in Badr Prison renewed the pretrial detention of human rights activist Nermeen Hussein and the photojournalist Hamdi Al-Zaeem despite exceeding the legal pretrial detention maximum. The Public Prosecution must quickly issue a release without guarantee decision, like many of those released by the Supreme State Security Prosecution.

Holding the trials of dozens of citizens imprisoned in cases of a political nature, continued before exceptional circuits inside detention facilities of the Ministry of Interior, far from the courts of the Ministry of Justice, which made them legally defective and lacking fair and just trial standards, making the rulings issued by them unjust. .
