Legal Comment
The 10th of Ramadan Prison administration has prevented Marwa Arafa’s lawyer from visiting her, despite an official permit from the Public Prosecution.
This constitutes a flagrant violation of the Constitution and the law, as well as a violation that is even more serious, in light of the recent reports that Marwa had suffered a pulmonary embolism while in prison, making her right to communicate with her lawyer a fundamental and urgent matter.
Furthermore, denying her lawyer access to visit her, despite the permit from the Public Prosecution as well as the disregard of the Public Prosecutor for this violation, put them as either helpless or complicit in this violation.
Cairo Criminal Court, Terrorism Chamber-II, held in Badr Prison issued its decisions to renew the detention of cartoonist Ashraf Omar and activist Sherif El-Rouby during a session on Monday, 25 August, 2025, without their presence or even their appearance on the screen designated for hearing the renewal sessions.
The decision was then taken and then departed the court, before the remaining cases were heard and the subsequent renewal decisions were issued on paper.
This is a clear violation and blatant disregard for the constitution and the law, and for the rights of the defense and guarantees of a fair trial.
This behavior is not just a procedural violation, but rather a grave deviation in the work of the judiciary, as it transforms the renewal session from a fundamental guarantee of freedom into a mere formality to provide a sham legal cover for continued detention.
What happened clearly reveals that pretrial detention decisions are being used as a tool of punishment, undermining confidence in justice and undermining the rule of law.
