Mr. Ali Abbas Barakat, the lawyer who is in remand detention, died inside his prison cell in Badr Prison, after he was transferred pending a case after obtaining an acquittal in May 2022, following a sharp deterioration in his health condition.
Legal Comment
– The investigations of the Supreme State Security Prosecution with citizens who appear from varying periods of enforced disappearance and accusing them of joining terrorist groups and committing crimes of financing them did not stop. During the period of coverage of the bulletin, the Supreme State Security Prosecution investigated 38 citizens who were arrested during different periods and from different governorates and centers. Within the scope of the Arab Republic of Egypt and the issuance of pretrial detention decisions without the presence of a fair investigation by the Public Prosecution and being content with the records of the investigations ruled by the officers of the National Security Sector, which the Supreme State Security Prosecution considers a certified book with it that does not need other evidence to support and recommend it, as the Court of Cassation ruled in many of its rulings .
– The decision of the Supreme State Security Prosecution to release 64 citizens from pretrial detention came as a usual step in the same place that does not benefit progress or movement forward, in light of the investigation and issuance of pretrial detention decisions for dozens of citizens by the same prosecution.
– The Cairo Criminal Court closed the curtain on the trial of Boutros Ghali, the former Minister of Finance during the era of former President Mohamed Hosni Mubarak, by annulling the 15-year prison sentence and obligating him to return the amount of 35 million and 791 thousand pounds and fining him an equal amount, and to eliminate the criminal case by conciliation in the case known in the media as the customs corruption case. In which Boutros-Ghali was accused of wasting public money, profiteering, and making an illegitimate gain, and the proceedings of the trial began after the revolution of the twenty-fifth of January, against the background of his exploitation of his influence and the issuance of Ministerial Resolution No. 165 of 2005 according to which certain types of selected cars were collected and held at the disposal of their owners at the interest Customs inside a customs yard attached to the Ministry of Finance, and he disposed of these cars without the consent of their owners by allocating 6 cars of them for his personal convoy and 96 cars for other parties, whose value amounted to 35 million and 791 thousand pounds, which led to unlawful consumption of these cars and a decrease in their price in violation of Law No. 66 of the year the Amendment of 1963 regarding customs and its executive regulations, which requires keeping these cars in their condition to hand them over to their owners after paying the fees or selling them and depositing the owner’s share in the treasury of the Customs Authority. However, Egyptian law permitted the return of illegally acquired sums in return for completing reconciliation procedures and closing the criminal case.
– The death of Mr. Ali Abbas Barakat, the lawyer who is in pretrial detention pending one of the cases, after he was rotated after obtaining an acquittal ruling in May 2022 from the Zagazig Misdemeanor Court of Appeal, inside his prison in the Badr City Reform and Rehabilitation Center without the officials inside the center announcing the causes of his death, which raises suspicion and doubt concerning the care of detainees and prisoners from a medical point of view.
