1- Arrest and Detention

Tuesday 14 November

  1. Security forces at Darb Negm Police Station arrested Ammar Mohamed Fayyad and Ahmed Mohamed Fayyad, the two sons of former parliamentarian, Eng. Mohamed Fayyad, and took them to an unknown destination without presenting them to any investigating authorities yet.

  1. The Supreme State Security Prosecution interrogated (during the newsletter’s coverage period) 28 citizens, and put them in pretrial detention for joining a terrorist group and financing and supplying a terrorist group.

Monday, 13 November

  1. 10th of Ramadan Prosecution Office in Sharqia investigated 4 citizens (Kamel Mansour Mohammad, Magdi Abdel Raseq, Medhat Abdel Fattah, and Shawqi Fathi) after arresting them from their homes, and accused them of joining a terrorist group and spreading false new.
  2. Zagazig Prosecution Office in Sharqia investigated Citizen Mohammad Al-Sadeq Awadallah after 42 days enforced disappearance, accused him of joining a terrorist group and spreading false new, and then placed him in pretrial detention.

Wednesday, 15 November

  1. Abu Hammad Prosecution Office in Sharqia investigated both Citizens Salah Eid Dahrouj, and Abdel Rahman Ahmed Mohamed, after 70 days enforced disappearance, on charges of joining a terrorist group and spreading false news.

3- Detention Renewal:

Monday, 13 November

  1. Cairo Criminal Court, Terrorism Circuit-III, in Badr Prison renewed the detention for dozens of citizens held in pre-trial detention pending cases. Case Numbers are 662 of 2020, 626 of 2021, 1935 of 2021, 1983 of 2021, 2380 of 2021, 41 of 2022, 670 of 2022, 294 of 2023, 325 of 2023, 540 of 2023, 1160 of 2023, Supreme State Security.
  2. Mansoura-1 Prosecution renewed the detention of  citizen Mohammad Al-Shazli Al-Shazli Al-Nagdi for spreading false news, for 15 days pending investigations in Case No. 7148 of 2023, Administrative Mansoura-1.
  3. South Mansoura Public Prosecution renewed the detention of Eng. Sameh Wahid Fahmy Ali for publishing false news and statements and joining a terrorist group, for 15 days pending investigation in Case No. 5670 of 2023 Administrative Aga.

  1. Cairo Criminal Court, Terrorism Circuit, in Badr Prison renewed the detention for dozens of citizens held in pre-trial detention pending cases. Wednesday, 15 November

  1. Hahia Prosecution Office in Sharqia renewed the detention of  citizen Ahmed Raafat Othman, known as Ahmed Marei (a founding member of the Constitution Party in the party’s secretariat in Hahia) for 15 days in Cairo pending investigations in Case No. 12135 of 2023, Misdemeanors Hahia.

 

4- Release from Court:

Monday 30 October

  1. Zagazig Criminal Court, Terrorism Circuit, renewed the detention of citizens Abd al-Rahman Mohammad al-Said Mohammad Deabis, Ibrahim Mohammad Ahmad Abu Zaid, Mahmoud Mohammad Elian, Shehab al-Din Ramadan, Saeed Mohammad Abd al-Hamid Ammar, Ahmad Mohammad Shehata, Abd al-Rahman Mahmoud, Ahmad Abd al-Baqi, Hamada al-Essawi, and Mohammad Abd al-Karim Attia. The renewal was with a L.E. 5,000 financial guarantee for each, accusing them of joining a terrorist group and spreading false news.

5- Release from police custody:

Monday, 13 November 

  1. Security forces at the 10th of Ramadan Police Station in Sharqia released Al-Said Abdel Aziz Mohamed Mohamed, Bahaa El-Din Mohamed Attia, Mohamed Sabri Mohamed, Mohamed Shaaban Mohamed, Essam Mohamed Shaaban, Mohamed Fawzi Khalifa, and Suhaib Fathi Barakat, after their detention for 10 days following the decision to release them pending the arrival of the National Security signal.

 

Wednesday, 15 November 

  • Security forces at the 10th of Ramadan Police Station in Sharqia released Mahmoud Mohammad Musa, and Al-Said Mohammad Mustafa Salama, following the decision to release them from 10th Misdemeanor Court on charges of possessing publications and spreading false news.

Monday, 13 November

  1. Cairo Criminal Court, Circuit-II Terrorism held in Badr Prison postponed the trail of 11 defendants, in the case known in the media as the Rabia Al Adawia sit-in dispersal case, to the sentencing session on 11 January 2024.

 

Tuesday, 14 November

  1. Hahia Misdemeanor Court of Appeal, Terrorism Circuit, postponed the trial of both defendants Mohamed Al-Said Abdel-Rahim, and Mohamed Adel, on charges of publishing false news, to the sentencing session on 28 November 2023.
  2. Cairo Criminal Court, Circuit-II Terrorism held in Badr Prison postponed the retrial of 1 defendant in the case known in the media as Al-Muneeb Violence Incidents Case to the session of 14 December, 2023.

 

Wednesday 15 November

  1. Cairo Criminal Court, Circuit-II Terrorism held in Badr Prison, postponed the trial of 22 defendants in the case known in the media as the administrative structure of the Muslim Brotherhood to the session of 6 January 2024.

 

Saturday, 18 November

  1. Cairo Criminal Court, Terrorism Circuit-I held in Badr Prison postponed the trial of 5 defendants in the case known in the media as Helwan Specific Committees Cell case for sentencing on 2 March 2024.
  2. The same chamber, postponed the trial of 5 defendants in the case known in the media as the Ismailia Terrorist Cell case to the session of 2 December 2023.
  3. Zagazig Criminal Court, Terrorism Circuit, postponed the trial of the Ahmed Emad Abdel Maaboud Mohammad in Case No. 32576 of 2023, Zagazig Misdemeanor, of publishing false news, to the session on 25 November 2023.
  4. The same circuit postponed the trial of Ahmed Mohamed Al-Said Ibrahim in Case No. 32575 of 2023, Zagazig Misdemeanor, on publishing false news, to the session of 25 November 2023.
  5. The same circuit postponed the trial of Al-Baraa Imam Abdel Hafeez and Ahmed Maher Mohsen Abdel Hamid in case No. 31562 of 2023, Zagazig Misdemeanor, on publishing false news, to 25 November 2023.

  1. Cairo Criminal Court, Circuit-I held in Badr Prison postponed the trail of 1 defendant in the case known in the media as the ISIS 5th Settlement case.

Wednesday 15 November

  1. Cairo Criminal Court, Terrorism Circuit-II held in Badr Prison, ruled to sentence 1 defendant, to 3 years aggravated imprisonment in his retrial in the case known in the media as the Al-Waili violence case.
  2. Cairo Criminal Court, Terrorism Circuit-II held in Badr Prison, ruled to acquit 1 defendant in his retrial in the case known in the media as the Badrashin ISIS cell case.

 

8- Statements:

Saturday 18 November

  1. Ministry of the Interior official Facebook page announced the organization of a training course in cooperation with the International Committee of the Red Cross in the field of international humanitarian law, as a contribution to spreading a culture of human rights among its employees.

 

9- Judicial Decisions

Wednesday 15 November

  1. Criminal Court issued a ruling to lift the funds seizure status off political activist Hossam Moines (former official spokesperson for the Popular Movement). The decision was in Case No. 957 of 2021 Supreme State Security, charging him , along with politician Ziad Al-Eleimi and 5 others, of publishing news and false statements, for which he got a presidential pardon after a final conviction ruling.

The court issued a decision to address the Central Bank of Egypt, to implement the decision, after the approval of the Attorney General’s advisor to end the order No. 35 of 2019, seizing his funds and properties.

 

Legal Comment

 

Pretrial detention increasingly widespread in its application by terrorism circuits in the trial of various crimes has become a phenomenon that conflicts with the freedom and lives of citizens subject to it and its provisions. In this context, Terrorism Circuits in Cairo Criminal Court, held in Badr Prison renewed the detention of dozens of citizens throughout the week in a number of cases, to aggravate the crisis of pretrial detention in Egypt and turn it into an alternative punishment to judicial rulings.

 

In a clear violation of the personal freedom of citizens, which the Constitution considers a fundamental right that should not be infringed, National Security and General Security in Sharqia arrested both Ammar Mohammad Fayyad and Ahmed Mohammad Fayyad, both son of Eng. Mohammad Fayyad (former parliamentarian on Darb Negm district), taking them to an unknown destination without disclosing their place of detention, allowing them to speak to their lawyers or families, or presenting them to any investigative body.
