In the appeal submitted by the Egyptian Ministry of Interior, a sergeant and police secretary accused of torturing and killing the martyr Khaled Saeed, the Cairo Court of Appeal decided to amend the ruling issued by the Court of First Instance by obliging the Ministry of the Interior to pay compensation of one million pounds to the family of the martyr Khaled Saeed and reduce the value of the compensation to an amount of 500 thousand pounds.

The death of the citizen / Ali Amer inside his prison in Burj Al-Arab prison, due to the deterioration of his health condition, and he was buried under security guard. It is mentioned that he was arrested in 2016 from Al-Santa Center in Gharbia Governorate.

 

Legal Comment

The rotating of citizens who obtained release decisions in cases of a political nature has returned to the scene once again. The Hyhia Prosecution Office in Sharkia Governorate investigated two citizens, after they were charged in a new case, carrying the same accusations as the cases they were released from. A decision was issued to remand them in pretrial detention again based on the prepared investigation reports, which were recorded by the National Security Sector officers, who deliberately send messages to all citizens, that they are the only ones who own the citizens’ destinies inside Egypt: “The New Republic,” and that no voice is louder than theirs. There is no judiciary, judges, or prosecution, and that their investigations are the only irrefutable evidence of who is considered a patriot and who is considered a terrorist, without the need for any other evidence, in an unfortunate and miserable scene that expresses the conditions of justice in the Arab Republic of Egypt.

 

The ruling of the Cairo Court of Appeal, which was obtained by the Egyptian Center for Economic and Social Rights, obligated the Ministry of the Interior to grant the family of the martyr Khaled Saeed a civil compensation of 500,000 Egyptian pounds for material and moral damages, as well as inherited compensation, as a result of security personnel affiliated with the Egyptian Ministry of Interior by torturing and killing the young Khaled Saeed in June 2010. The incident of his murder and his pictures circulating were the first and main spark for the revolution of January 25, 2011. This verdict is a victory for the family of the martyr Khaled Saeed, and for the efforts of independent human rights institutions, and the curtain finally falls on one of the most important issues in Egypt during the last two decades which took more than 13 years.

 

– At a time when two families of those imprisoned in Egyptian prisons announced the death of their relatives inside their prison, and their burial amid strict security measures, the Ministry of the Interior issued a statement, which it published on its official page on the social networking site Facebook, to deny what it described as allegations of channels and websites loyal to the terrorist Brotherhood, concerning the death of a detainee inside his prison as a result of a number of violations. The Ministry’s statement was content with listing that the death was the result of a severe drop in blood circulation, and that the detainee was receiving treatment in the prison’s hospital. However, the statement of the Ministry of Interior is considered sent speech that requires clear and compelling evidence about the condition of the detainee before and during his entry into prison, and what medical procedures were taken inside his prison. Likewise, the Public Prosecution must open an investigation into the death incident, go to the place of detention of the deceased, and hear the statements of his colleagues in complete confidentiality, away from the eyes of the security forces responsible for the place of detention, as well as hear the statements of the family of the deceased.

 

– The decision of the Second Misdemeanor Court, Nasr City, to extend the sentence to the engineer, Yahya Hussein Abdel-Hadi, on the grounds of his accusation of publishing false news and statements, after he wrote two articles on his personal page on the social networking site Facebook. This brings back the scene of persecuting opinion-holders who oppose the policies of the current regime with trials that lack fair and equitable trial standards for the purpose of taking revenge on them and not for the purpose of imposing the rule of law.

 

– At a time when the Egyptian Ministry of Interior ignores official communications and telegraphic telegrams regarding the absence of many citizens, and the claim of their families that security forces came to their homes, arrested them, and did not present them to any of the investigation authorities, and demanded from them the role they are assigned to play according to the text of the Egyptian constitution, by searching and investigating the whereabouts of these people, and revealing and clearing up the matter regarding their fates, the official page of the Ministry of the Interior on the social networking site Facebook came out, to deny what it described as the re-publishing of the video of a woman’s complaint that the security services arrested her son unlawfully, hostile to the state, which send a message that the Ministry of Interior limited its role to monitoring what is published on social media platforms and ignoring official communications.
